At Shopminii, we strive to maintain the highest standards of service. To support our restaurant and delivery partners, we follow a strict policy regarding the commitment made once an order is placed.
1. Cancellation Policy:
Finality of Orders: Once an order is placed on the Shopminii platform, it is immediately transmitted to our restaurant partners for preparation. Therefore, no cancellations are allowed after the order has been confirmed.
100% Cancellation Fee: If a customer attempts to cancel a confirmed order, or if the order cannot be fulfilled due to customer-side issues, 100% of the order value will be collected as a cancellation fee. This fee is used to compensate the restaurant for the prepared food and the delivery partner for their journey.
2. Non-Refundable Scenarios (Customer Default):
Shopminii reserves the right to cancel an order and retain the full payment (no refund) in the following situations caused by the user:
Mismatch Address: Providing an incorrect or incomplete delivery address.
Out of Zones: Placing an order for a location that falls outside our active delivery radius.
Wrong Phone Number: Providing an incorrect contact number that prevents communication.
Unreachable Customer: Failure to pick up phone calls or respond to the delivery partner at the time of delivery.
Inaccessibility: Locked premises or refusal to accept the order at the doorstep.
3. Refund Eligibility:
A full or partial refund will only be considered at the sole discretion of Shopminii in the following cases:
The order is cancelled by the restaurant or Shopminii due to item unavailability.
The order is cancelled due to a company-side technical error or logistical failure.
The food packaging is severely tampered with or damaged at the time of delivery (proof required).

This policy is governed by the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
Contractual Obligation: Under the Indian Contract Act, 1872, placing an order constitutes a "contract." Once the restaurant starts preparation, the service provider incurs a cost. Charging a 100% cancellation fee in such cases is a common industry practice to recover "liquidated damages" (actual losses).
Unfair Trade Practices: To remain compliant with the Central Consumer Protection Authority (CCPA), Shopminii ensures that these charges are clearly disclosed before the user places an order. Transparency in terms prevents the policy from being classified as an "unfair contract".
Delivery Responsibility: While the customer is responsible for providing accurate contact details, the service provider must demonstrate an "attempt to deliver." If a customer is unreachable, the loss of perishable food justifies the retention of the order amount.
